USA: NEW RULES ON PLASTIC POLLUTION AND NO TOXICS IN FOOD PACKAGING ACTS

On October 25th, the congress reintroduced in the Senate and the House of Representatives the Break Free from Plastic Pollution.
If this bill is enacted, it will introduce an EPR policy and set goals for the reduction of usage of single-use plastic products and beverage containers.

This action would ban from the market certain single-use beverage containers, including those with polyethylene glycol or a toxic substance.

PFAS, orthophthalates and bisphenol compounds are included in the bill’s definition of toxic substances. The list of banned items is long, we have for example: food service products made of foam; plastic utensils, stirrer, splash sticks, cocktail sticks, or toothpicks, single-use condiment plastics; black plastics and non-compostable produce stickers.

These new rules would impose a permitting moratorium for plastic facilities. This option would restrict the raising of new permits for these facilities under the “clean air act of the federal water pollution control act” which was a similar legislation which failed to be approved in 2021.
